By accessing or using our website, mobile application, or any other services provided by TrustyApp (collectively, the "Services"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services. By clicking “I Accept” or by otherwise accessing or using the Services, you agree that you have read and understood, and, as a condition to your use of the Service, you agree to be bound by the following terms and conditions.
2. Use of Services
(a) Eligibility: You must be at least 13 years old to use our Services. By agreeing to these Terms, you represent and warrant to us that: (a) you are at least 13 years old; (b) you have not previously been suspended or removed from the Service; and (c) your registration and use of the Service is not in violation of any and all applicable laws or regulations. If you are accessing our Services on behalf of a entity, you represent and warrant that you have the authority to bind that entity to these Terms.
(b) Account Registration: To access our Services, you may need to create an account. When registering for an account, you may be required to provide us with personal information including, but not limited to, your name, email address, or photo. You agree that you are responsible for maintaining the confidentiality of your account information and agree to accept responsibility for all activities that occur under your account. (c) Prohibited Conduct: You agree not to:
Use our Services for any illegal or unauthorized purpose.
Post or transmit any content that is defamatory, obscene, or violates any third-party rights.
Attempt to gain unauthorized access to our Services or our users' accounts.
Use automated systems, such as bots, to access our Services.
Interfere with or disrupt our Services or servers.

4. Intellectual Property
(a) Ownership: All content and materials on our Services, including but not limited to text, graphics, logos, images, software, and trademarks, that are owned by TrustyApp or its licensors are protected by copyright and other intellectual property laws.
(b) Third-Party Content: TrustyApp may include content from third-party sources, such as reviews or quotes from other publications, for informational purposes. We strive to ensure that we have the necessary rights or permissions to use such content. However, if you believe that your intellectual property rights have been infringed upon, please contact us immediately. The Service may host Third-Party Content, or include links to other websites or applications. We do not control or endorse any Third-Party Content or Third-Party Service. You agree that we are not responsible for the availability, accuracy, or content of any such Third-Party Content or Third-Party Service. Your use of and reliance on any Third-Party Content or Third-Party Service is at your own risk.
(c) Attribution: When we use material from external sources, we provide proper attribution and include a link to the original source whenever feasible. Users are encouraged to review the original source for additional context and information.
(d) User-Generated Content: Users who contribute content, including but not limited to photos, restaurant reviews, lists, names, and bios, to our Services retain ownership of their submissions. We may use Your Content in a number of different ways, including by publicly displaying it, reformatting it, incorporating it into advertisements and other works, creating derivative works from it, promoting it, distributing it, and allowing others to do the same in connection with their own websites and media platforms. By submitting content to TrustyApp, users irrevocably grant us world-wide, perpetual, non-exclusive, royalty-free, assignable, sublicensable, transferable rights to use Your Content for any purpose. Please note that you also irrevocably grant the users of the Service and any Other Media the right to access Your Content in connection with their use of the Service and any Other Media. Finally, you irrevocably waive, and cause to be waived, against Trusty and its users any claims and assertions of moral rights or attribution with respect to Your Content. By “use” we mean use, copy, publicly perform and display, reproduce, distribute, modify, translate, remove, analyze, commercialize, and prepare derivative works of Your Content.
(e) Limited License: TrustyApp grants you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes. You may not modify, reproduce, distribute, or create derivative works based on our content without our prior written consent.
5. Interpretation of Scores from Different Sources:
Trusty may aggregate and interpret reviews and scores from various sources, each of which may use different rating systems, in order to provide users with a unified scoring system for restaurants listed on the Trusty platform. This scoring system is designed to provide users with a comparative assessment of restaurants based on a standardized scale.
It is important to note that the interpretation of scores provided by Trusty is subjective and based on our own algorithms and methodologies. We make no assertions that our interpretation accurately reflects the intended meaning or value of the original scores provided by the review publishers or sources.
Users acknowledge and agree that Trusty's interpretation of scores is provided for informational purposes only and should not be construed as an endorsement, guarantee, or representation of the accuracy or validity of the original scores from the review publishers or sources.
Trusty shall not be liable for any discrepancies, inaccuracies, or errors in the interpretation of scores, nor for any decisions made by users based on such interpretations. Users understand that others may interpret scores differently, and Trusty disclaims any responsibility for the subjective opinions or interpretations of scores by users or third parties.
By using the Trusty platform, users acknowledge and accept that the interpretation of scores provided by Trusty is intended as commentary and analysis, and that Trusty assumes no liability for any reliance placed on such interpretations.
6. Accuracy Disclaimer
Trusty makes reasonable efforts to ensure the accuracy and reliability of the information provided on its platform, including aggregated scores from various sources. However, Trusty does not guarantee the completeness, reliability, or accuracy of such information. Users acknowledge that Trusty cannot verify the accuracy of all data provided by third-party sources and should use their own judgment and discretion when relying on such information.
7. No Endorsement
The inclusion of restaurants, reviews, or scores on the Trusty platform does not constitute an endorsement, recommendation, or guarantee by Trusty. Trusty merely aggregates and presents information from various sources for the convenience of its users. Users understand and acknowledge that Trusty does not conduct independent evaluations of the establishments or reviews featured on its platform, and users should conduct their own research and assessments before making any decisions based on the information provided.
8. User Responsibility
Users are solely responsible for verifying the accuracy, relevance, and suitability of the information provided on the Trusty platform before making any decisions based on it. Trusty encourages users to exercise caution and diligence when relying on aggregated scores or other information presented on its platform and to seek professional advice or conduct further research as needed.
9. User Feedback
Trusty values user feedback and encourages users to report any inaccuracies, errors, or discrepancies they encounter while using the platform. Users may submit feedback or inquiries regarding aggregated scores or other information to Trusty's customer support team. Trusty will make reasonable efforts to address user feedback and improve the accuracy and usefulness of its platform.
10. Responsibility for User Content
You are solely responsible for any content that you submit, post, or transmit through the Trusty platform ("User Content"). This includes, but is not limited to, reviews, ratings, comments, photos, videos, and any other material that you contribute.
By submitting User Content, you represent and warrant that you have all necessary rights, licenses, and permissions to do so, and that your User Content does not violate any third-party rights, including but not limited to copyrights, trademarks, privacy rights, or any other intellectual property or proprietary rights.
You acknowledge that Trusty does not endorse, verify, or guarantee the accuracy, completeness, or reliability of User Content. Trusty reserves the right, but not the obligation, to monitor, screen, edit, or remove User Content at our discretion, without prior notice.
You agree to indemnify and hold Trusty harmless from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your User Content, including but not limited to any claims alleging infringement of intellectual property rights, defamation, or violation of privacy rights.
11. Termination
TrustyApp reserves the right to suspend, disable, or terminate your access to our Services, with or without cause and without notice, at our sole discretion. Your account is for your personal, non-commercial use only, and you may not create or use an account for anyone other than yourself. We ask that you provide complete and accurate information about yourself when creating an Account in order to bolster your credibility as a contributor to the Service. You may not impersonate someone else, provide an email address other than your own, create multiple accounts, or transfer your account to another person without Trusty’s prior approval.
12. Disclaimers
(a) No Warranty: TrustyApp provides our Services "as-is" and without any warranty or representation of any kind, whether express, implied, or statutory.
(b) Limitation of Liability: To the extent permitted by law, TrustyApp shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our Services. In no event shall Trusty be liable for any inaccuracies, errors, or discrepancies in the aggregated scores or other information provided on its platform. Trusty shall not be responsible for any direct, indirect, incidental, consequential, or punitive damages arising out of or relating to the use or reliance on such information. Users agree that their use of the Trusty platform is at their own risk, and Trusty shall not be liable for any loss or damage incurred as a result of such use.
13. Indemnification
You agree to indemnify, defend, and hold harmless Trusty, its affiliates, officers, directors, employees, agents, licensors, and partners from and against any claims, demands, actions, losses, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
Your use of the Trusty platform;
Your violation of these Terms of Service or any applicable laws or regulations;
Your infringement of any third-party rights, including but not limited to intellectual property rights, privacy rights, or contractual rights;
Any User Content you submit, post, or transmit through the Trusty platform;
Your interactions with other users of the Trusty platform or any third parties, including but not limited to businesses listed on the platform.
This indemnity obligation will survive any termination or expiration of these Terms of Service and will apply to any claims arising during or after your use of the Trusty platform.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the state of Delaware without regard to its conflict of law principles.
15. Changes to Terms
TrustyApp reserves the right to modify or update these Terms at any time. We will notify users of significant changes through our website or other means. Your continued use of our Services after the effective date of any changes constitutes your acceptance of the updated Terms.
16. International Use
The Service is intended for visitors located within the United States. We make no representation that the Service is appropriate or available for use outside of the United States. Access to the Service from countries or territories or by individuals where such access is illegal is prohibited.
